EU Notification

Same as the Cosmetic Directive 76/768/EEC, the EC 1223/2009 dictates no Pre-Market Registration of a Cosmetic product in Europe. None the less, the requirement to complete a Pre-Market Notification of a Cosmetic product is mandatory for any Cosmetic product.

The Notification can only be completed by the designated Responsible Person and only AFTER the Product Information File encloses all evidence of conformity.

The Notification of a Cosmetic product indicates that:

  ✓   A Responsible Person has been designated to the product
  ✓   The Product Information File holds all evidence of conformity
  ✓   The product is about to be placed on the European market

Untill the CPNP (Cosmetic Product Notification Portal) is made available the Pre-Market notification of all Cosmetic products must be completed to any of the Authorities & Poison Centers of the individual EU states in accordance to their national provisions. This action may be completed only by the Responsible Person and before placing the product on the market - No commercialization of a cosmetic product can be performed without a foregoing Notification, according to the Directive and the Regulation (!)

The information to be submitted to the CPNP (to be available by the application dates below) includes but is not limited to:

  ✓   Product category + name(s) enabling specific identification
  ✓   Name and Address of the Responsible Personn where the PIF is made readily accessible
  ✓   Country of origin (for imported products)
  ✓   First Member State where the cosmetic product is to be commercialized in
  ✓   Presence of Nano-Materials
  ✓   Presence of CMR 1A/1B substances
  ✓   Frame formulation
  ✓   Labeling

Application dates for Notification to the CPNP (Cosmetic Product Notification Portal):

	Already on the market	New products
Notification of products	January 11th, 2012 and no later than July 11th, 2013	Prior to placing on the market
Notification of products with Nano-Materials	January 11th, 2013 and no later than July 11th, 2013	6 months before placing on the market
